1. Use of the Site
1.1 These Terms and Conditions govern your agreement with Antidote Health Products Ltd (Anitdote Health Products, we or us) and/or use of the website (The Site). Please read them carefully. Registration and/or use of this site will constitute agreement to and acceptance of these terms and conditions
1.2 In order to use this site and place an order you must be at least 18 years old.
2. Registration
2.1 You must ensure that the details provided by you on registration and/or at any time are correct and complete.
2.2 You must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
2.3 You must provide an email address upon registration and by doing so consent to us using it to provide you with information on your order, changes to our service or any special offers.
3. Antidote Health Products’ right to suspend or cancel your registration
3.1 Antidote Health Products may suspend or cancel your registration immediately if you breach any of your obligations and/or at our reasonable discretion under these Terms and Conditions.
3.2 You can cancel this agreement at any time by informing us in writing. If you do so, you must stop using the Site.
4. Practitioner Discounts
4.1 Practitioners must open a practitioner account. A practitioner is a person who is qualified and practising in a natural methodology of healing, such as nutrition or naturopathy.
4.2 To open an account we will require proof of your qualification and practice. We reserve the right to refuse registration as a practioner at our discretion.
4.3 In order to register, and place orders please phone Customer Services for details.
4.4 Orders from clinics and retailers must be placed by phone.
5. Password and security
5.1 On registering to use the Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password and/or your personal details. If you know or suspect that someone else knows your password you should notify us by contacting Customer Services (see below for contact details) immediately.
5.2 If Antidote Health Products has reason to believe that there is likely to be a breach of security or misuse of the Site, we may require you to change your password.
6. Cancellation and Returns policy
6.1 We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.
6.2 In respect of non-perishable items, you have the right to cancel the contract at any time until the expiry of the 7th working day after the date of delivery of the goods by notifying us in writing. You must arrange for return of the goods and bear the cost of doing so.
6.3 Goods should be returned unopened with the inner and outer seals intact and in a re-saleable condition.
6.4 In the case of perishable items you do not have the right to cancel the contract. Should you wish to cancel your order we shall be entitled to charge you in full for an amount equal to the price of any perishable items contained in your order.
6.5 Please notify us of cancellation and changes to your order by sending an email to [email protected]. If your order has not been processed then it will be possible to cancel or amend the order as requested. However if the order has been processed and dispatched, then you may wish to return the items in accordance with our returns policy.
6.6 If the above criteria regarding our cancellation and returns policy have been met, any refund due will be applied to the payment card used less any deduction for postage and packing.
7. Prices
All prices are expressed inclusive of any VAT payable unless otherwise stated. All prices are subject to change without notice.
8. Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you.
9. Acceptance
You will be charged for the goods and delivery when you place your order. There will be no contract of any kind between you and us until you have paid for the goods and delivery and have received an email from us confirming that your order has been processed.
10. Amendments
The Terms and Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your site visit or purchase.
11. Delivery
11.1 Delivery will be made to the address specified by you during the order process on the website. You have the ability to change this address with each order through the website. We reserve the right to restrict deliveries in certain areas.
11.2 All of our deliveries require a signature on receipt. It is your responsibility to ensure that an appropriate person is available at the delivery address on the delivery day. An appropriate person must sign for all goods on delivery. If no one is at the address when the delivery is attempted the goods will be retained by us. We will leave notification of delivery and you will have the option to rearrange delivery or collect your order from the local Post Office sorting centre as noted on the delivery card.
11.3 Please note adverse weather conditions or other events outside of our reasonable control may result in the occasional late or cancelled delivery. If that is the case we will endeavour to contact you as soon as we are able to in order to reschedule your delivery time and date. In any event, our liability to you will be limited to the price of goods not delivered and the cost of delivery.
11.4 We will ordinarily only make deliveries when an appropriate person is able to receive the delivery. In the event that you instruct us to leave a delivery unattended at your address we expressly disclaim all liability which may arise by virtue of the delivery being left unattended for a period of time. This includes but is not limited to theft, tampering, contamination and the result of any change in temperature.
12. Defective or damaged goods
12.1 We guarantee the quality of our goods. You must inspect the goods and notify us promptly in writing or by phone of any dissatisfaction with your order. We will promptly and fully refund the price of any goods that are not of satisfactory quality or arrange for the delivery of replacement goods, provided that you notify us within 2 days of delivery of the goods. We will arrange with you for the return of the goods..
12.2 Any damaged parcels or breakages must be notified to us within one day of receipt of the goods.
12.2 We will not accept any further claims for loss from or in connection with the supply of faulty goods, whether direct, indirect, consequential or otherwise, howsoever arising.
13. Promotional offers and Codes
13.1 Discount codes can only be used on full price items and cannot be used in conjunction with any other promotional or discount offers.
13.2 Certain offers are only available for a limited period and while stocks last. If your order is received after the offer period or the goods are no longer available at the offer price, we will notify you before we dispatch the goods.
13.3 Refunds for goods purchased under a promotional offer will be based on the terms of the promotional offer and price.
If after placing your order you amend your order the prices charged will be those applicable at the time your amended order is processed.
14. Availability of the Site
14.1 Although Antidote Health Products aims to offer you the best service possible; Antidote Health Products makes no promise that the services at the Site will meet your requirements. Antidote Health Products cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to Customer Services and we will attempt to correct the fault as soon as we reasonably can.
14.2 Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Antidote Health Products will attempt to restore the service as soon as it reasonably can.
15. Antidote Health Products’ liability
15.1 The Site is provided by Antidote Health Products without any warranties or guarantees. You must bear the risks associated with the use of the Internet.
15.2 The Site provides content from other Internet sites or resources and while Antidote Health Products tries to ensure that material included on the Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Antidote Health Products will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Site. If Antidote Health Products is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.
15.3 In particular, we disclaim all liabilities in connection with the following:
a) Incompatibility of the Site with any of your equipment, software or telecommunications links
b) Technical problems including errors or interruptions of the Site
c) Unsuitability, unreliability or inaccuracy of the Site
d) Inadequacy of the Site to meet your requirements
15.4 To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Site.
15.5 We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire and flood.
15.6 Our maximum liability arising out of any order for the supply of goods to you under this contract will be limited to the retail price of the goods contained in that order.
16. Third Party Websites
Antidote Health Product’s Site includes links to other web sites or material; the content in these sites are beyond its control. Antidote Health Products is not responsible for content on the Internet or World Wide Web pages or any reliance placed on it.
17. Advertising and Sponsorship
Part of the Site may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on the Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.
18. Applicable Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
19. International Use
Antidote Health Products makes no promise that materials on the Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
20. Expiry Date on Payment Card
20.1 Please ensure that the expiry date of your payment card is after the day that you place your order. Payment is taken at the point of ordering the goods and in the event that the payment card has expired we will be unable to take payment and fulfil your order.
20.2 We reserve the right to terminate our agreement with you if we are refused authority for payment or reasonably believe that payment will be refused at any stage.
21. Miscellaneous
21.1 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
21.2 If any of these Terms and Conditions are held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
21.3 If you breach these Terms and Conditions and Antidote Health Products ignores this, Antidote Health Products will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
21.4 A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
